Terms of Use
Effective July 22, 2026
These Terms of Use govern your access to BirdChess, a chess training service operated by Applied Quanta. By accessing or using BirdChess, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If you are under the age of majority where you live, a parent or legal guardian must permit your use.
You are responsible for the activity associated with your account and for maintaining access to your email or Google account. Do not share sign-in links, impersonate another person, or create accounts through automated or deceptive means. Notify us if you believe your account has been accessed without permission.
The BirdChess service
BirdChess provides opening lessons, position drills, progress tracking, review tools, and related educational features. We may add, remove, test, suspend, or change features as the product develops. We do not promise that a particular lesson, opening line, evaluation, or feature will always remain available.
Chess instruction and AI-generated explanations are educational aids. They may contain errors and do not guarantee tournament results, rating improvement, or any other outcome.
Acceptable use
You may not:
- Use BirdChess in violation of law or another person’s rights.
- Interfere with the service, probe for vulnerabilities, bypass usage limits, or attempt unauthorized access.
- Use bots, scrapers, or automated systems to extract substantial portions of the service or its curriculum without written permission.
- Reverse engineer or circumvent technical protections except where applicable law expressly permits it.
- Upload or submit malicious code, unlawful material, or content you do not have the right to use.
- Use the AI coach to generate abusive, harmful, deceptive, or unlawful material.
Your content
You retain ownership of questions, game records, feedback, and other content you submit. You give BirdChess a non-exclusive, worldwide license to host, process, reproduce, and display that content only as reasonably necessary to operate, secure, improve, and support the service. You represent that you have the rights needed to submit that content.
BirdChess content and intellectual property
BirdChess, including its software, curriculum, lesson text, artwork, branding, and interface, is owned by Applied Quanta or its licensors and is protected by intellectual-property laws. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use BirdChess for your own chess training.
Chess moves, positions, and game facts may not themselves be proprietary, but BirdChess’s selection, arrangement, explanations, artwork, and presentation remain protected.
Paid services
If BirdChess offers a paid plan, the price, billing period, included features, and any trial terms will be shown before purchase. Subscriptions renew until canceled unless stated otherwise. You may cancel future renewal through the billing controls made available with the service. Payments are processed by Stripe. Taxes and refunds are handled as disclosed at purchase and as required by applicable law.
Third-party services
BirdChess relies on third-party services such as Google, Cloudflare, Stripe, Chess.com, and Lichess. Their own terms and policies may govern your interaction with their services. BirdChess is not responsible for third-party services outside our control.
Suspension and termination
You may stop using BirdChess at any time. You may request account deletion by emailing privacy@birdchess.com. We may restrict or terminate access when reasonably necessary to protect BirdChess or its users, investigate misuse, comply with law, or address a material violation of these Terms.
Disclaimers
To the extent permitted by law, BirdChess is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, secure, or error-free operation.
Limitation of liability
To the extent permitted by law, Applied Quanta and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunity arising from BirdChess. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid BirdChess during the 12 months before the claim or 100 US dollars.
Some jurisdictions do not allow certain warranty exclusions or liability limits, so portions of this section may not apply to you.
Changes
We may update these Terms as the service changes. We will post revised Terms here and update the effective date. If a change materially affects your rights, we will provide additional notice when required. Continued use after the revised Terms take effect means you accept them.
General
If a provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, financing, or sale of the service. These Terms and the Privacy Policy are the entire agreement between you and BirdChess concerning the service.
